As part of the policy development process, foreign institutions advocated for operational flexibility in India. The result is two progressive regulations—the IFSCA Regulations and UGC Regulations. These provide autonomy to foreign educational institutions in various aspects such as academic programs, fee structures, student admissions, faculty hiring, and infrastructure development. While commendable, there’s room for additional support and clarity from the government.
Streamlining processes for efficiency
While the regulatory framework is flexible, challenges remain. The receipt of grants and donations from foreign sources, a significant income source for educational institutions, demands streamlined processes with clear timelines. Clarity on restrictions imposed by the Foreign Contribution Regulation Act (FCRA) is also essential, especially concerning organizations with foreign nationals in executive positions.
Further streamlining is needed for GIFT City and UGC Regulations. The financial burden on students due to the requirement for fee payments in foreign currency under IFSCA Regulations could be alleviated by permitting payments in INR through the Union Budget 2024. Additionally, a reevaluation of UGC Regulations restricting online education can align with the post-COVID world’s acceptance of technology-driven learning.
Fast-track patent processes
To foster research and development, a fast-track process for patent application and grants is proposed for educational institutions. Granting patents signals innovation, and reducing timelines can encourage better research endeavors in the country.
